This low level of :('unds available for new programs is due to high numbers of expected continuations. At the advice and counsel of the MCSC Funding Committee, the MCSC did not run an open application process this year. However, we solicited applications from two Governor' s initiatives: the Campaign to End Homelessness and the Cities of Promise. The Corporation for Supportive Housing on behalf of the Campaign to End Homelessness, submitted an application. Approximately 45 people replied to the survey sent out via Survey Monkey. Results showed that people want the public celebration, that it was important to have the winners meet the Govemor and/or have them on stage with the Govemor, and that it is also important to have individual recognition for winners and finalists. • • • • • • • The Committee agreed not to book a headliner for the 2008 event unless it is camped. The suggestion was to contact JeffDaniels. The headliner does not seem to attract attendees. The attendees come to support the wim1ers, finalists , and volunteerism in general. The Conunittee reconm1ends that we continue to have local talent perform at the event. The Committee asked staff to contact Rochelle Riley to see if she is interested in serving as our 2008 emcee. The Committee agreed to hold the 2008 event at the Fox Theater given that it holds the required numbers, and saves funds due to camped rental fees. Staff indicated the stage at the DIA is not wheelchair accessible from inside the theater and therefore not appropriate as a venue. The Committee asked staff to explore other areas of the state for future events. The Conunittee agreed that we should continue to have winner videos as they do a great job in telling the awesome stories ofthe winners. There will be another summit in Lansing on October 20. This is an area where the MCSC's programs will be able to offer assistance. Michael went through the draft agenda for the MCSC Board Meeting scheduled for April 25, 2008. Executive Committee members did not have any changes . MCSC Commissioner Retreat It was discussed whether to hold the Commissioner Retreat in one day instead of two days. A one-day session would benefit Commissioners as everyone is very busy. Others shared that having the 2-day retreat gives Commissioners the opportunity to network with one another. Committee members agreed to continue with the 2-day retreat. �ServiceNation Ms. Michael gave background on ServiceNation. Alan Khazei , cofounder of City Year, and CEO of Be the Change, Inc., asked the Governor to serve on the leadership council for planning the 2008 National and Community Service Summit that TIME Magazine is convening in New York City on September 17-18. The Summit will engage more than 500 national leaders to endorse a bold and comprehensive plan for bringing national service to scale in the United States. If the Governor agrees to serve as a member of the Leadership Council, she will be the first Governor to commit. Ms. Michael would also like the MCSC to serve as an organizer. The MCSC's involvement would entail participating in conference calls and having a voice in drafting national service policy for a "Declaration of Service" to give Congress and Presidential candidates. The Committee agreed that a Commissioner along with Musette and Paula could represent the MCSC. The Executive Committee recommends the MCSC join the planning committee for ServiceNation Summit. We will provide more information and gather feedback at the April 25 MCSC Board Meeting. Governor's Service Awards 111 The Governor's Service Awards gala is confirn1ed for June 19 at the Fox Theater in Detroit. Finalists and winners will be selected via a conference call today with the GSA Committee. Commissioner Mawby would like more recognition for the finalists , not just the winner. Chairman Mulhern would like the MCSC to contact Herman Miller next year for help with nominations in the corporate category as volunteerism is part of their corporate culture. It would be worthwhile to strengthen the pool of corporate nominations. National Conference on Volunteering and Service MCSC staff will attend the conference in Atlanta, GA in June. Commissioners will be asked if available to attend the conference. Chairman Mulhern recommends that the MCSC present at the national conference. Staff will explore this opportunity for the 2009 conference. Mentor Michigan Census The Mentor Michigan Wave V census numbers will be corrected to reflect Michigan only numbers. There were also a few programs who reported late so their numbers will be added. Members will provide educational assistance to youth and to recruit volunteers. All partner sites will consist of schools and community-based organizations in Michigan's Upper Peninsula. Members will work with 360 struggling K-12 students to increase their scores in the subject tutored by one-halfletter grade, with a goal of achieving success for a minimum of 65% of those tutored. Members will enhance youth mentoring programs for 100 students in grades 6-12, with 70% of those served indicating (via survey) improved skills in conflict-resolution, social skills and character development. Members will also develop and enhance programming for 70 youth ages 0-5, with the goal of increasing school readiness skills among at least 70% of those served. Additionally, members will recruit 600 community volunteers, providing 8,000 hours of service in support of daily program activities and community-wide service projects. Finally, 100% of full time members will participate in bi-weekly trainings using MCSC and CNCS developed materials to increase understanding of key citizenship principles and to aid in the development of a strong interest in life-long civic engagement. Boys & Girls Club of Benton Harbor-The Smart Choice Project Counties Served: Berrien The MCSC respectfully recommends that the Boys & Girls Club ofBenton Harbor-The Smart Choice Project (BGCBH) be awarded $131,306 in formula funding to engage 10 MSYs to serve youth within the Boys & Girls Club after school and summer programs for 2008-09. Members will serve 800 youth through after school and summer programming that focuses on five core areas set by Boys & Girls Club of America. Those areas are: Character & Leadership, Health & Life Skills, Education & Career Development, Sports/Fitness & Recreation, and The Arts. 85% of students will show an increase in student life skills as a result of service as measured by pre and post assessments. Members will also engage 250 non-AmeriCorps volunteers who will serve 2,500 hours in support of these activities. All members will receive training in citizenship and civic engagement though internal BGCBH and MCSC sponsored trainings with 85% of members indicating an increase understanding of key citizenship principles and a strong interest in life-long civic engagement. Camp Fire USA West Michigan Council- Neighborhood Youth Development Counties Served: Kent The MCSC respectfully recommends that Camp Fire USA be awarded $136,174 in formula funding to engage 12 MSYs (3FT, 15 HT, 4 RHT) to serve the youth ofKent County for 2008-09. Members will serve 1,535 low-income youth at 9 after-school and 6-8 summer program sites; deliver Self-Reliance to 700 youth; lead youth in 2 organization-wide service-learning projects. As a result of these activities, 80% of after-school and summer youth will indicate that they have acquired critical developmental assets as defined by The Search Institute of Minneapolis. Members will engage 250 non-AmeriCorps volunteers who will deliver 2,000 hours of service to Camp Fire youth. Additionally, all members will participate in regional trainings in conjunction with the MCSC where 80% of members will indicate an increase understanding of key citizenship principles and a strong interest in life-long civic engagement. �Char-Em lSD AmeriCorps Program Counties Served: Charlevoix, Emmet The MCSC respectfully recommends that the Char-Em lSD AmeriCorps Program be awarded $113,500 in formula funding to engage 10 MSYs to serve youth within the Char-Em ISD for 2008-09. Members will mentor 150 identified at-risk youth with 80% of teachers reporting some, or a great deal of progress, in student academic progress, attendance, disciplinary referrals and social behavior. 50% of all mentored youth will show a decrease in disciplinary referrals and increase attendance rates. Members will also engage 250 nonAmeriCorps volunteers who will serve 750 hours in support of community and school specific projects. All members will receive training in citizenship and civic engagement though internal Char-Em and MCSC sponsored trainings with 85% of members indicating an increase understanding of key citizenship principles and a strong interest in life-long civic engagement. Communities in Schools Detroit - the readetroit corps Counties Served: Wayne The MCSC respectfully recommends that the readetroit corps AmeriCorps program, hosted by Detroit Communities in Schools, be awarded $313,125 in CNCS formula funding to support 25 MSYs. Members will serve elementary schools within the Detroit Public Schools system, providing a wide range of literacy and enrichment activities to at least 480 students over the course of each year in order to increase excitement about and interest in reading, with a resulting demonstrated increase in reading skills. Members will recruit, train and support 250 community volunteers to provide students with tutoring and mentoring services, in addition to other community activities. Members will participate in a wide range of professional and citizenship development training opportunities and activities. Good Samaritan Ministries - AmeriCorps Faith in Youth Partnership Counties Served: Ottawa, Allegan -greater Holland and Zeeland areas The MCSC respectfully recommends that the AmeriCorps Faith in Youth Partnership program, hosted by Good Samaritan Ministries, be awarded $131,050 in CNCS formula funding to support 10 MSYs. Members will establish and/or continue mentoring and after-school programs for children attending the area's six middle schools. The goal of the Partnership is to improve academic achievement and promote a sense of well being, particularly for youth at-risk due to isolation or poverty. The program will be supported through partnerships with local churches and faith-based organizations. The churches will host the AmeriCorps members and provide volunteers and space for the youth activities. The program will help 75% ofthe 460 youth served achieve positive behavioral changes, as measured by youth surveys. A total of 50 new community volunteers will be recruited, and 100 existing volunteers will be supported, in order to serve as mentors, provide academic assistance, or assist with after-school programming. Overall the goal of the program will be to establish Neighborhood Alliances to foster "connectedness" between caring adults and local youth. Finally, members will participate in trainings using MCSC and CNCS developed materials to increase understanding of key citizenship principles and to aid in the development of a strong interest in life-long civic engagement. The Guidance Center- Downriver CARES AmeriCorps Counties Served: Wayne The MCSC respectfully recommends that the Downriver CARES AmeriCorps program, hosted by The Guidance Center, be awarded $217,227 in CNCS fommla funding to support 18.8 MSYs (17FT, 9 MT). Members will serve community organizations and schools throughout southern Wayne County to provide assistance in a number of child development issues. Members will work with 400 youth in the areas of literacy, mentoring, after-school programming and therapeutic services, with 80% ofyouth surveyed indicating an �improvement in both their attitudes toward group work and in their personal development inventories. Members will be responsible for recruiting 70 community-based mentors to be matched and work with one assigned student each for two hours per week for one full year. Mentors will log approximately 3,640 hours. In addition, members will also be responsible for recruiting 150 volunteers who will log 4 hours each for bimonthly community service projects. Overall, 220 community volunteers will be recruited and trained, logging 4,090 hours of service. Additionally, 100% of members will participate in trainings using MCSC and CNCS developed materials to increase understanding of key citizenship principles and to aid in the development of a strong interest in life-long civic engagement. Habitat for Humanity of Michigan- Michigan Habitat's AmeriCorps Program Counties Served: Berrien, Calhoun, Genesee, Huron, Ingham, Iron, Jackson, Kalamazoo, Kent, Macomb, Monroe, St. Clair, Wayne, and Wexford. The MCSC respectfully recommends that the Michigan Habitat's AmeriCorps Program, hosted by Habitat for Humanity of Michigan, be awarded $234,508 in CNCS formula funding to suppmi 20 MSYs (12FT, 4 HT, 24 QT). Members will provide volunteer coordination, construction, family service support, Vision 2020 Community support, and sustainable building services to Habitat for Humanity affiliates throughout the state. Members will serve as Family Support Liaisons for 25 new families by supervising them in their sweat equity as well as their required pre-occupancy training requirements, with 20 successfully completing their sweat equity and training in order to move into their homes. Members will recruit and manage 1,000 new volunteers annually who will provide 8,500 hours of service in support of local Habitat for Humanity affiliates. 800 of those volunteers will return to volunteer on an ongoing basis. Members will also serve as Construction Liaisons to improve the safety, training and satisfaction of construction volunteers, in order to increase the number of trained volunteers returning to serve. Additionally, 100% of members will participate in trainings using MCSC and CNCS developed materials to increase understanding of key citizenship principles and to aid in the development of a strong interest in life-long civic engagement. Huron Pines Counties Served: Alcona, Alpena, Cheboygan, Crawford, Ingham, Iosco, Montmorency, Ogemaw, Oscoda, Otsego, Presque Isle, and Roscommon. The MCSC respectfully recommends that Huron Pines, a nonprofit dedicated to conserving the forests, lakes and streams of northeast Michigan, be awarded $130,901 in formula funding to engage 10 full time members to begin an AmeriCorps program to serve with regional watershed partner organizations in the areas of organizational development, volunteer recruitment and public outreach in 2008-09. Members will develop and implement shore or stream bank erosion control practices to preserve 1,500 linear feet of Michigan coastal/stream land. In support of these efforts and to increase the activity and membership base of local watershed organizations, members will recruit 200 volunteers to serve 1,050 hours throughout the 11 county region. Member service will aid in the organizational development of their partner organizations though the development of strategic plans and direct service to implement the goals these plans set forth so that 30% of the goals will be implemented in the initial year of the program. Members will also strengthen local conservation groups through public outreach and the development of three high-quality resource toolkits for targeted audiences that include riparian landowners, local officials and school groups. Additionally, 100% ofmembers will be trained using MCSC and CNCS developed materials to increase understanding of key citizenship principles and to aid in the development of a strong interest in continued civic engagement upon completion of their tern1 of service. �Marquette-Alger Regional Educational Service Agency- MARESA AmeriCorps Counties Served: Marquette, Alger The MCSC respectfully recommends that the Marquette-Alger Regional Educational Service AgencyMARESA AmeriCorps Program be awarded $149,268 in CNCS formula funding to support 13 MSYs (10FT, 6 HT). Members will provide educational services such as academic service-learning programs, after-school and enrichment programs, and academic mentoring to 3,000 youth in grades K-12. Members will serve in schools and community- and faith-based organizations in Michigan's Upper Peninsula. Overall goals will be to improve self-esteem among 50% ofyouth served, increase interest in school and learning and increase the number of the Search Institute's 40 Developmental Assets possessed by youth in the area. Additionally, members will recruit and manage 600 community volunteers to support activities. All members will receive training in citizenship and civic engagement in order to develop an understanding of key citizenship principles and a strong interest in life-long civic engagement. Michigan Primary Care Association Counties Served: Arenac, Kent, Muskegon, Roscommon, Saginaw and Wayne (projected). The MCSC respectfully recommends that the Michigan Primary Care Association (MPCA) AmeriCorps program be awarded $175,981 in formula funding to engage 14 MSY s to serve in community health centers throughout the State of Michigan for 2008-09. Members will serve 6, 125 uninsured and underinsured Michigan residents through community forums and other public outreach activities to gain information on services available; enable 6,500 patients to set, modify, or increase their self-management goals with 60% of identified chronically-ill patients reporting that they have remained compliant to their goals, thus contributing to a better quality oflife. Members will also engage 375 volunteers to assist in promoting national health campaigns. Additionally, 100% ofMPCA members will be trained using MCSC and CNCS developed materials to increase understanding of key citizenship principles and to aid in the development of a strong interest in continued civic engagement upon completion of their term of service. University of Michigan- Michigan AmeriCorps Partnership Counties Served: Wayne The MCSC respectfully recommends that the University of Michigan - Michigan's AmeriCorps Partnership (MAP) program be awarded $324,758 in formula funding to engage 27.75 MSYs (20FT, 2 HT, 27 QT) to serve the residents of Detroit and Dearborn, Michigan for 2008-09. Members will provide services in relation to education, the environment and human needs. Members will provide direct service at 25 sites to increase organizational capacity to area faith-based and community-based programs. This service will result in 90% of site supervisors indicating that members developed products that will improve organizational service delivery, and ultimately 85% of sites indicating that better able to meet their respective missions. Members will engage, train and support 1,500 community volunteers to provide 18,000 hours of direct service to help ensure the sustainability of area programs beyond the presence of AmeriCorps members. In the first three years the program will establish a mentoring program that will guide staff, administration and students through all elements of executing service-learning projects that meet local and global needs. Several community needs have already been identified and student project planning is underway. All three pilot projects will achieve a central goal of the school- a strengthened sense of belonging. After four years 100% of the K -12 bui Iding will be engaged in service-learning. Fitzgerald Public Schools Fitzgerald Public Schools' goal over the next six years will be to expand and develop a structured servicelearning program that will address core and non-core curriculum and provide an opportunity for students to experience service-learning at least one time in each school. Pilot activities will begin with a focus on a community food pantry. The district will also provide advanced level training in service-learning, provide networking opportunities for students and educators and create a long-term sustainable network and resources for service-learning. Montcalm Area Intermediate School District Montcalm Area Intermediate School District will implement service-learning throughout the county in each of the seven districts using the following goals for the 2008-2009 grant: 1) Increase teacher knowledge of servicelearning, authentic assessment and curriculum through professional development, 2) Increase student learning by integrating service-learning into core curriculum strands, 3) Institutionalize service-learning methodology into the school program to foster system change. More than 700 students will be engaged in the pilot year. Romulus Community Schools Romulus Community Schools is seeking a Learn and Serve- Michigan planning grant to create and enrich a service-learning program throughout the nine school buildings. With grant assistance and support from the MCSC, they will create a program that will tum service-learning into the thread that will be strung throughout the curriculum. After four years more than 4000 students will have participated in service-learning projects. Willow Run Community Schools As the Willow Run Community Schools begins to restructure and implement initiatives to counteract the factors that impeded student learning, the staff and administration have expressed a commitment to service-learning and the development of quality programs and services that effectively teach the content standards. Initially, the Willow Run Community Schools pilot will include three schools. The pilot project at the elementary level will focus on the environment while the middle school and high school projects will focus , respectively, on science and language arts/social studies curricula with the Community Based Vocational Instruction program also being utilized at the high school. Over the next three years, the program will be implemented in all district facilities. �IMPLEMENTATION The following schools/school districts are being recommended for implementation grants: Belding Area Schools The Belding Area School's service-learning program has been in development for seven years. With the help of grant funds from Learn and Serve - Michigan the district has been able to expand the knowledge of staff and is now working to help staff provide meaningful service projects to all grade levels at Belding Area Schools. In 2008-2009 grant year service-learning will to expand through the following goals: o Increase high quality professional development o Create grade level service-learning projects o Identification of roles for key personnel o Increase development of partnerships with local organizations o Increase networking time for educators The district's long term goals for this program are as follows: o A teacher champion/mentor in every building o A district wide service learning day o Service-learning incorporated into the curriculum and school improvement o A strong communication plan for service-learning o Strong on-going professional development Charlevoix Public Schools In 2008-2009, Charlevoix Public Schools will focus on building a sustainable service-learning program. The grant coordinator and curriculum teams will address school improvement goals by tying service-learning to state standards and benchmarks. The teams will address the goal for how service-learning can assist with high school redesign and supporting struggling students. They will continue training teachers on service-learning via professional development activities, core team meetings, and sharing of successes by pilot teachers during staff meetings. Training will continue to broaden at each level and more student voice will be sought via classroom teachers. The goals for service-learning will be connected to the new district wide strategic planning committee efforts. Chassell Township Schools The Chassell Township Schools' service-learning coordinator, district administration, and advisory board will work to increase service-learning in the district and take steps to sustain service-learning as a viable teaching model for their classrooms. Service-learning and Character Counts will be joined as an elective to support school improvement plans in the middle and elementary grades. They will also examine how service-learning can be used to prepare students for the workplace and continue to strengthen the connection to the community, especially through partnerships with Gogebic Community College and Michigan Tech Federal Credit Union. The program will seek additional participation in, and support for service-learning, through expanded professional development and public relations efforts. Grand Blanc Community School District The Grand Blanc Community School District is seeking funds to enhance their service-learning program that allows students and/or teachers to design service-learning activities around community needs based on their current studies. Allowing participants to design their own activity is an integral part of this initiative. Allowing students to take an active role in the design of their service-learning helps foster their sense of civic responsibility, empathy, higher-order thinking skills and problem solving skills. The coordinator plans �to use the program to help bridge the large socioeconomic gap that currently exists in the school district by giving students the opportunity to work together to solve shared community issues. The program will also provide the district a means to allow all students to achieve, and thereby elevate test scores in underperforming subgroubs. Inland Lakes Schools Inland Lakes Schools was awarded a Learn and Serve - Michigan planning grant in 2006. During the 20072008 school year, 12 service-learning projects were initiated by teachers- six more than originally projected. Additional program funding was provided by the local Kiwanis club and the Work Force Investment Act Youth Program. In 2008-2009 the focus of activity will be to work intensively with at least nine of the projects initiated this year, to improve and build projects based on the national service-learning standards. Approximately 300 students will participate. Projects that contribute to community revitalization will be encouraged. Kent Intermediate School District The Kent County Intermediate School District (KISD) supports instruction in the classroom and student achievement. The goal of their Learn and Serve- Michigan grant is to expand service-learning as an instructional methodology. Through this grant, KISD students will demonstrate academic and social skills while helping others at school and in the community. Students will demonstrate mastery in a core academic subject and develop employability skills. The program will be expanded by increasing the number of service-learning teachers and students, increasing the average number of student's hours in service-learning, providing professional development to showcase exemplary programs and to help schools build their own sustainability plans. Lake Orion Community Schools Lake Orion Community Schools continue to move from a "project-based" focus to a more integrated curricular approach. The program established an advisory board, created a new logo for the district and has spread the word about the program through PR materials and through the first annual "Spotlight on Service-Learning" held April 23rd. They have increased membership of students on the advisory board to increase student voice on issues and to make sure that there is continuity as students graduate. They will continue to provide servicelearning professional development to teachers and administrators and will seek ways to better integrate the training into district professional development plans. Onaway Area Community School For the 2008-2009 school year, Onaway Area Schools will build upon the successes of previous servicelearning experiences and partnerships, primarily focusing efforts on program expansion. There are four areas in which expansion is expected to occur. The first area of focus will be on building and increasing capacity and interest among staff members to develop and implement effective service-learning opportunities for students. Next, they will work to further engage students and community members in the various phases of programming. An additional area of focus will be to continue to nurture existing community partnerships, while fostering new relationships. Finally, it is their desire to deepen the role of service-learning in the school beyond the curriculum and into other areas, particularly school improvement initiatives . �Pennfield Schools Pennfield Schools has three goals for service-learning: o Improve student perfonnance and achievement through service-learning. o Help to develop and internalize the attitudes and perceptions of students and teachers regarding the personal and civic value of service-learning o Meet documented needs within the community To achieve these goals, Pennfield Schools will expand the magnitude and scope of its service-learning activities during the 2008-2009 school year. The components of expansion include: 1) build leadership capacity to support more and deeper service-learning activities; 2) expanding professional development activities in all buildings each semester; 3) sending teachers on site visits to observe operations in districts with thriving service-learning curricula; 4) expanding outreach from the district into the community to seek opportunities for collaboration with area citizens and businesses; 5) expanding the size and purpose of the Service-Learning Steering Committee; 6) reformulating some of the existing clubs and organizations within the district to integrate more service-learning activities within their purpose and operations, and; 7) augment the evaluation plan to include formative and summative elements that will allow for program improvement as well as articulating the outcomes and impact of service-learning in the district. Traverse City Area Public Schools In 2007-2008 the Traverse City Area Public Schools (TCAPS) piloted a Youth-to-Youth Initiative (Y2}j : Learning for Action which focused on a micro-finance service-learning program for middle school and high school students. This year, the program will be expanded to extend the delivery of service-learning curriculum into new grade levels, new content areas, and supports their multi-year strategy for establishing K-12 servicelearning integration with TCAPS' curriculum. They will provide tools and instructional strategies that link service to curriculum and help students to sucesssfully learn and apply concepts of financial literacy, stewardship of natural and financial resources, and global citizenship. YMCA Service-Learning Academy During their 2007-2008 pilot year the YMCA Service-Learning Academy key staff, including faculty from Eastern Michigan University and two master level instructors, lead staff in the development of projects that engaged all 1,112 students in service-learning. In 2008-2009 they will again engage all staff and students in service-learning and do greater outreach to more partners. Local match dollars will support staff travel for professional development and service-learning supplies. INSTITUTIONALIZATION The following schools are being recommended for institutionalization grants: CASMAN Alternative Academy At CASMAN Alternative Academy service-learning is not viewed as a separate part of education. The goal of this sixth year program is to continue using service-learning as a teaching methodology and to provide students with hands-on projects that promote academic achievement, positive relationships, appropriate social skills and student connectedness. In 2008 -2009 the administration will include service-learning in all core classes at each grade level , coordinate sequential service-learning projects across subjects, increase student roles at all stages of projects development, align service-learning with state benchmarks, develop partnerships and a balance of one time projects and other long term interdisciplinary projects. �Clarkston Community Schools In its final year of grant eligibility, Clarkston Community Schools will continue to build upon and improve the service-learning program. New school-wide projects at four of the schools enable teachers, parents, community and students to collaborate while serving. In 2008-2009 professional development will be refined as they build up on successful service-learning 101 and service-learning 201 workshops. Mini grants will be offered and teacher leadership will be enhanced. For the first time, Clarkston Junior High School will offer a service11 learning elective class and all 1i grade government classes will include a service-learning experience. This year nearly 3,000 students will be engaged in service-learning. Copper Country Intermediate School District The Copper Country Intermediate School District (CCISD) will continue to expand service-learning into its 13 constituent districts through professional development opportunities, support in planning projects and evaluation of teacher, student and partner feedback. Teachers will have the opportunity to participate in professional development experience that range from introductory to advanced sessions. The CCISD will partner with the Western Upper Peninsula Center for Science, Math and Environmental Education to implement the Lake Superior Stewardship Initiative funded by the Great Lakes Fisheries Trust. Additionally, steps to ensure sustainability will be a focus at the advisory board level. Lowell Area Schools Lowell Area Schools is implementing a plan that will integrate service-learning at multiple levels in each grade span, so students will have the opportunity to work with and serve people in the "real world" throughout their years in school. The key element in making this happen is continued planned and progressive training and support of teachers and administration, as well as businesses and organizations within the community. Marquette-Alger Regional Educational Service Agency Marquette-Alger Regional Educational Service Agency (MARESA) will expand professional development opportunities for teachers, administrators and other school staff by at least 50% this year. The program advisory board will continue to meet and guide MARESA staff in developing policy and supportive practices for the program. MARESA will emphasize the institutionalization of the program in local districts within their service area by encouraging them to adopt policies as well. Williamston Community Schools Pre-Kindergarten through 121h grade service-learning activities in Williamston Community Schools are purposefully designed to start with the curriculum standards at each grade level with links to real world problem solving. At the center of the service-learning curriculum is the belief that community service can be a tool to deliver curriculum that is rigorous and relevant but also helps students build relationships with their community. MCSC Commissioner Retreat The Comm issioner Retreat will need to be rescheduled due to the Executive Director's Meeting and State Service Commissioner Institute takin g place during the same period. It was recommended that the retreat be scheduled in conjunction with the High School Drop Out Summit taking place on October 20th in Lansing. With the Comm issioners requesting that some the MCSC program goal s focu s on drop out prevention, this would be a great opportunity for Commissioners to attend the Summit and then continue the discussion during the MCSC Board Retreat. Executive Committee members agreed to begin the retreat on Mond ay, October 20, at 4:00pm and conclude on Tuesday, October 21. Rotary Charities of Traverse City Joseph Sowmick Learn and Serve- Michigan School-based Grants Sagina w Chippewa Indian Paula VanDam gave background on the staff recommendations (see attached memo from Ms . VanDam dated June 27, 2008.) She explained that the MCSC offers three categories of program funding for the Learn and Serve-Michigan School-based grants- planning, imp lementation, and institutionali zation. Detroit Renaissance High School requested an extension of it's planning grant due to delays caused by stafftumover. A one-year extension was granted. After MCSC review, staff recommends all 17 for funding. There was discussion around how to get Detroit Public Schools involved with service-learning. Commissioner Parker agreed to have a conversation with his contacts in the district to share information about service-learning. Sue Carnell is also on the DPS staff and would be good to pull into the conversations. Angelia Salas is developing a service-learning tool for addressing the high school dropout issue. She is working with Skillman Foundation and its Great Schools Initiative. Chairman Mulhern asked for a motion to support the staff recommendations for the Leam and ServeMichigan School-Based new planning grants and renewal funding for implementation and institutionalization grants. Commissioner Mawby moved to support the motion and Commissioner Niester seconded the motion. The motion passed unanimously. Michigan's AmeriCorps Formula Funding Ms. VanDam explained that the MCSC received $2,630,074 for AmeriCorps formula funding. This was a reduction of $152,394 from last year. All 14 of the currently funded formula programs are eligible for renewal funding. Thirteen programs submitted proposals requesting more than $2.9 million. The Michigan Department of Agriculture decided not to reapply. Two programs, Michigan Primary Care Association and Habitat for Humanity, had difficulty fillin g th eir member slots this year. Therefore, staff is recommending a level equal to the number of slots that they were able to fill during this cunent year. The remaining programs were reduced an average of 5% of MSYs based on their FY07 allocation. The allocation cut due to reduced funds was as equitable as possible. The MCSC staff recommends renewal funding for the following applicants: B-H-K Child Development Board ($391,611), Boys & Girls Club of Benton Harbor ($131,306), Camp Fire USA West Michigan Council ($136, 174), Char-Em lSD ($113,500), Communities in Schools - Detroit ($313 , 125), Good Samaritan Ministries ($131 ,050), The Guidance Center ($217,227), Habitat for Humanity Michigan ($234,508), Huron Pines AmeriCorps ($130,901), Marquette Alger RESA ($149,268), Michigan Primary Care Association ($175,981), University of Michigan ($324,758), and Volunteer Muskegon! ($179 ,875). Chairman Mulhern asked for a motion to support the staff recommendations for AmeriCorps formula funding . Commissioner Parker moved to support the motion and Commissioner Mawby seconded the motion. The motion passed unanimously . Chairman Mulhern suggested that the MCSC share the positive measurables from the programs with th e media. He suggested an "AmeriCorner" once a month in daily newspapers. Commissioner Mawby also recommended that the value of AmeriCorps members and the impact on their lives and communities needs to be shared with elected officials. School districts that have not received funding in the past and who have limited experience with service-learning apply for planning grants to develop a plan to establish service-learning throughout the district. School districts that have received funds in the past apply for implementation grants to expand quality service-learning practice in the district. School districts that have implemented service-learning for three years apply for institutionalization grants to sustain quality service-learning practice. Districts may request funds according to funding category (planning, implementation, institutionalization) and school district pupil count. Their responses are below : Melanie Colaianne -The company lost 15,000 employees; her office is down to just herself and secretary; she doesn't feel she can make a meaningful contribution, so isn't seeking a reappointment. She still plans to be at the October retreat. And MASCO will still contribute to GSA. joe Lubig - He is very interested in a reappointment, and called Janice to find out the process. Dr. Russell Mawby- He has expressed a wish to retire from the Board but was told (by me) he is needed. Someday he may get his wish. Donna Niester- After careful consideration, she is very interested in a reappointment. She recently attended the Comm issioner Institute in D.C. (at her own expense) and is planning to share what she learned about Board engagement, etc. Marsha Smith -After careful consideration, she is very interested in a reappointment. However, she will not be able to attend the October retreat. Joseph Sowmick - He did not sound interested in a reappointment, but will leave it to Dan's discretion. He bel ieves his seat on the MCSC Board is a placeholder until a seat on the Central Michigan University board opens up, which he hopes happens in the near future. Larry Williamson - After careful consideration, and assessing Comcast's level of support, he i:; very interested in a reappointment. Eileen Wilson-Oyelaran - She wants to wait until she sees the meeting schedule for 2009 before making a decision whether to seek reappointment. Recommendation: The Board appoint a Board Development Committee at the retreat to conduct a new board member search. Please let me know if you have any questions. The moti on passed un animously. Michigan 's AmeriCorps Formula Funding Paula VanDam explained that the MCSC was able to requ est addition al fo rmula fun ds from CNCS. The MCSC received our full request of29 MSYs and $369,25 6. T hese additional funds will allow us to fund the programs at the 2007-08 fundin g level and will make up for the cut they received in June due to lower formul a fundin g. There were two programs that staff recommended not receive additional fundin g du e to tbe programs not being able to fill their slots last year and al so havin g some retention issues. The programs will address these issues this yea r and we bope to get tbem back �to their original numbers. The additional funds will allow us to fund a new Ameri Corp s program with 20 members that will focus on the elimination of homelessness. The program is aware that the funding is for one year due to the supplemental funding and they will need to re-compete funding next year. The new program is the Corporation for Supportive Housing. It is a pariner with the Michigan State Housing Development Authority (MSHDA) and its Campaign to End Homelessness. Commissioners Niester and Collier have both heard of the organization and had positive comments about them. MCSC Staff requested flexibility to the funding recommendations to allow them to redistribute the MSYs if the programs cannot fill them. The MCSC staff is recommending additional funding for B-H-K Child Development Board, Camp Fire USA West Michigan Council, Communities in Schools - Detroit, The Guidance Center, Marquette Alger RESA, University of Michigan, Volunteer Muskegon, and new funding for Corporation for Supportive Housing (see memo from Paula VanDam dated August 14, 2008 with funding chart) for a total of248 MSYs and $2,999,330 funding. Chairman Mulhern asked for a motion to support the staff recommendations for AmeriCorps Supplemental Formula Funding. Commissioner Collier moved to support the motion and Commissioner Niester seconded the motion. The motion passed unanimously. Chaim1an Mulhern asked to receive information on the ratio of AmeriCorps members compared to other states. Commissioners Mawby and Collier suggested that Julie Fisher Cummings (newly appointed to the CNCS board) be kept updated on activities in Michigan by providing her with a one page summary outlining not only successes in Michigan but also what some of our challenges are. Dan would like to meet with Julie when he is in New York in September. Commissioner Collier will help schedule meeting. Julie is also invited to the AmeriCorps Member Celebration in Lansing to swear in new members, and to attend the MCSC board meeting. Reappointment of Members There was discussion around the reappointment of Commissioners whose terms expire in October. Dan will write them to find out their interest in serving another tenn, after which Musette will follow up via phone call. We will hold off reappointment decision until after the October Commissioner Retreat. MCSC Board Retreat Commissioners would like the first day to focus on the history of the MCSC, the mission of the MCSC, and future of the MCSC. During the transition discussion, it will be helpful for Commissioners to share their experience going through a transition either at their workplace, other boards or commissions, etc. Commissioners also were in favor of having an organi zed activity to get to know other Commissioners. The MCSC is recommending that we fund the Michigan State University Extension at the requested level of $317,896. This program will enroll 20 full -time members to serve as Housing Case Managers (19) and Volunteer Coordinator (1). AmeriCorps members will fill a critical gap in services in the statewide effort to eliminate homelessness. They will do this by performing outreach activities and assisting individuals experiencing homelessness or at-risk of homelessness to assess barriers to housing, develop a plan, and identify housing opportunities. The goal in the first year is to reach a minimum of 760 individuals statewide. Members will also serve as case managers, working with families to transition out ofhomelessness, and to assist youth aging out of foster care to access permanent housing. Finally, members will create ongoing relationships linking individuals experiencing homelessness with host site Continuum of Care agencies, community housing, and service providers in order to enhance the overall movement to end homelessness. This program will build on and access the resources available as a result of the partnership between the Corporation for Supportive Housing (national), the Michigan State Housing Development Authority, and its Campaign to End Homelessness. These entities have strong and efficient models and practices already in place, and have demonstrated the capability to properly manage federal grant funding . The addition of the AmeriCorps program will provide a mechanism for closing gaps in services statewide. Q: Who has the right to inspect public records? A: A "person" has a right to inspect, copy or receive copies of a public record of a public body upon making an oral or written request that describes the record sufficiently to enable the public body to find it. A request that is absurdly overbroad, such as one requesting "all correspondence" between a local police department and "all federal law enforcement/investigative" agencies, has been held to insufficiently identify specific records . A "person" is defined as an individual, corporation, partnership, firm, organization or association. 2. Q: What is a "public body"? A: The term "public body" includes a state officer, employee, agency, department, division, bureau, board, commission, council, authority, or other body in the executive branch of state government. The term does not include the governor or lieutenant governor, the executive office of the governor or lieutenant governor, or employees thereof. 3. Q: What is a "public record"? A: A "public record" is a writing prepared, owned, used, in the possession of, or retained by a public body in the performance of an official function, from the time it is created. 4. Q: Does it matter what form the public record takes? A: The term "writing" includes handwriting, typewriting, printing, photostating, photographing, photocopying, and every other means of recording. This definition is broad enough to cover nearly any form a public record might take. 5. Q: What public records are subject to disclosure? A: Generally, all public records are subject to disclosure except those that are .J.isted as exempt from disclosure in the act. 6. Q: Does the Act require a public body to summarize information to respond to a request? A: No. The Act does not require a public body to make a compilation, summary or report of information that is not otherwise specifically required by law. The act also does not require the public body to create a new public record when one does not already exist in order to respond to a 1 v �request. Likewise, the Act does not require that information be recorded by a public body, but when information is recorded it must be disclosed. 7. Q: What public records are exempt from disclosure under the Act? A: Section 13 of the Act creates 20 exemptions from disclosure. Some of the more commonly relied upon exemptions are the following: 1. Information of a personal nature when disclosure would constitute a clearly unwarranted invasion of an individual's privacy, such that the individual's right to have the information protected from public scrutiny outweighs the public's right to disclosure of the information. 2. Records or information specifically described and exempted from disclosure by statute. 3. Information or records subject to the attorney-client privilege and certain other enumerated privileges (i.e., doctor-patient, psychologistpatient, priest-penitent, or other privileges recognized by statute or court rule). 4. Communications and notes within a public body or between public bodies of an advisory nature to the extent that they cover other than purely factual materials and are preliminary to a final agency determination of policy or action. This exemption will not apply unless the public body can show that in the particular instance the public interest in encouraging frank communications between officials and employees of public bodies clearly outweighs the public interest in disclosure. 5. Trade secrets or commercial or financial information voluntarily provided to an agency for use in developing governmental policy if certain criteria are met. 8. Q: When a portion of a request for disclosure falls under one of the exemptions, can a public body withhold the entire record? A: No. If a record contains both exempt and nonexempt materials the body must separate the exempt from the nonexempt materials, which are still subject to examination and copying by the general public. 9. Q: Who may bring an action to compel disclosure of public records? A: The requesting person may bring an action to compel disclosure in circuit court. 2 �10. Q: What remedies are available under the Act? A: If the court determines that the public records are not exempt from disclosure, the court shall order the public body to produce the record. The court shall also award reasonable attorneys' fees, costs, and disbursements to a person who prevails in an action to compel disclosure. If the circuit court finds that the public body has arbitrarily and capriciously violated the act by refusal or delay in disclosure, the court shall also award punitive damages of $500.00 to the person seeking disclosure. 3 �OPEN MEETINGS ACT 1. Q: Who is subject to the provisions of the Act? A: All "public bodies," which includes "any state or local legislative or governing body, including a board, commission, committee, subcommittee, authority, or council, which is empowered by state constitution, statute, charter, ordinance, resolution, or rule to exercise governmental or proprietary authority or perform a governmental or proprietary function, or a lessee thereof performing an essential public purpose and function pursuant to the lease agreement." 2. Q: What constitutes a "meeting"? A: When there is a quorum of the public body's members and they meet for the purpose of deliberating toward or rendering a decision on a public policy. All decisions or deliberations of a public body constituting a quorum of its members must be made at a meeting open to the public. 3. Q: May a "public body" meet informally in advance of a public meeting to decide what will be formally decided at the public meeting? A: No. Meetings at which a quorum deliberates a public question, whether they are formal or informal, must be open to the public. However, the Act does not apply to a social or chance gathering or conference not designed to avoid the Act. Committee meetings constituting less than a quorum of the public body need not be held in public session. 4. Q: What public bodies are exempt from the requirements of the Act? A: The following public bodies are expressly exempt from the Act when they are deliberating the merits of a case: 1. Workers' Compensation Appelate Commission 2. Employment Security Board of Review 3. Michigan Veterans Trust Fund Board of Trustees 4. Teacher Tenure Commission 5. Arbitration panels selected by the Employment Relations Commission 4 �5. Q: What notice must a public body give of its meetings? A: A meeting of a public body cannot be held unless public notice is given. At the beginning of each calendar or fiscal year a public body that meets regularly must post a notice within 10 days after its first meeting of that year stating the dates, times, and places of its regular meetings. 6. Q: What does the public body do if there is a change in its regular meeting schedule? A: The change must be posted within three days after the meeting at which the change is made. For a rescheduled regular or a special meeting of a public body, a public notice must be posted at least 18 hours before the meeting. This 18-hour requirement does not apply to special meetings of subcommittees of a public body. 7. Q: How must a public body give notice of its future meetings? A: Notice must always be posted at the public body's principal place of business and any other location considered appropriate by the public body. Cable television may be used to post notice. The notice must contain the name of the public body to which the notice applies, its telephone number if one exists, and its address. If the public body is part of a state department or institution of higher education, a public notice must also be posted in the respective principal office of the state department or institution of higher education. 8. Q: What if the public body does not have a principal office? A: The public notice for a state public body without a principal office must be posted in the office of the Secretary of State. 9. Q: May a public body meet without complying with the notice requirements in the event of an emergency? A: Yes. If there is a severe and imminent threat to the health, safety, or welfare of the public and 2/3 of the body's members decide that a delay would be detrimental to efforts to lessen or respond to the threat, then the public body need not give notice. 10. Q: What is the extent of the public's right to attend a meeting under this Act? A: Their rights include the right to tape record, to videotape, to broadcast live on radio and to telecast live on television the proceedings of a public meeting. However, the public must comply with any reasonable rules established by the public body to reduce the possibility of disruption. 5 �11. Q: Axe minutes required to be kept for all meetings? A: Yes. The public body must keep minutes of all its meetings, whether closed or not. 12. Q: What must be recorded in the minutes of a meeting? A: The following items must be recorded in the minutes: 1. a statement of the time, date and place of the meeting; 2. the members present and absent; 3. any decisions made at a meeting open to the public and all roll call votes; and 4. the purpose or purposes for which a closed session is held. 13. Q: Are the minutes freely accessible to the public? A: Yes, unless they are from a closed session. 14. Q: When may a public body call a closed session? A: A 2/3 roll call vote of the members elected or appointed to the public body is required to call a closed session for the following reasons: 1. to consider the purchase or lease of real property up to the time an option to purchase or lease that real property is obtained; 2. to consult with the public body's attorney about trial or settlement strategy in connection with specific pending litigation, but only if an open meeting would have a detrimental effect on the public body's litigating or settlement position; 3. to review the specific contents of an application for employment or appointment to a public office if the candidate requests that the application remain confidential. However, all interviews for employment or appointment to a public office must be held in an open meeting; or 4. to consider material exempt from discussion or disclosure by state or federal statute. 6 �A closed meeting may be called without a 2/3 vote for the following reasons: 1. to consider the dismissal, suspension, or disciplining of, or to hear complaints or charges brought against, or to consider a periodic personnel evaluation of, a public officer, employee, staff member, or individual agent, if the named person requests a closed hearing; 2. to consider the dismissal, suspension, or disciplining of a student of a public school or institution of higher education when the student or the student's parent or guardian requests a closed hearing; 3. a strategy or negotiation session connected with the negotiation of a collective bargaining agreement when either negotiating party requests a closed hearing; and 4. partisan caucuses of the state legislature. 15. Q: Who may bring a civil action against a public body that does not comply with the Act? A: The Attorney General, prosecuting attorney of the county in which the public body serves or any person may bring a civil action in the circuit court to invalidate a decision of a public body allegedly made in violation of the Act or to compel compliance with the Act. A public body may re-enact a disputed decision in conformity with the Act without being deemed to make an admission contrary to its interest. 16. Q: What remedies are available under the Act? A: The court may invalidate the decision that was reached at the meeting and award court costs and actual attorney fees to the person bringing the action. 17. Q: What other penalties exist for violation of the Act? A: A public official who intentionally violates the Act is guilty of a -misdemeanor punishable by a fine of not more than $1,000.00 and may be held personally liable in a civil action for actual and exemplary damages of not more than $500.00 total, plus court costs and actual attorney fees. 7 �E'llUCS & CONFLICT OF INIERESI ~ 1. Q: What statutes affect my ethical obligations as an appointee of the Governor? A: The "Conflict of Interest Act" MCL 15.301 et seq., and the "Ethics Act", MCL 15.341 et seq.l The Conflict of Interest Act was enacted to fulfill the mandate of Article 4, sec. 10 of the Michigan Constitution that "[n]o member of the legislature nor any state officer shall be interested directly or indirectly in any contract with the state or any political subdivision thereof which shall cause a substantial conflict of interest." 2. Q: Who is covered by the Conflict of Interest Act? A: The Act covers members of the legislature and all "state officers." The legislature attempted to limit the definition of the term "state officer" in section 3 of the Act, but in a 1974 opinion the Attorney General determined that the statutory definition was unconstitutional. To be safe it should be assumed that the Conflict of Interest Act covers .wl. executive branch appointees or elected officials who exercise a part of the state's sovereign authority (as opposed to those in advisory positions), as well as state legislators. 3. Q: What limitations does the Conflict of Interest Act place on my financial dealings with the state? A: The Act provides that no state officer "shall be interested directly or indirectly in any contract with the state or any political subdivision thereof which shall cause a substantial conflict of interest." The term "interested" is defined as a pecuniary interest substantial enough to induce the interested party to promote the contract for his or her own personal benefit. 4. Q: How does the law define a "substantial conflict of interest"? A: JJnfortunately, the Act does not give a positive definition of what constitutes a "substantial conflict of interest." Rather, section 4 of the Act gives examples of contracts that do not constitute a !The Ethics Act applies only to "employees" and "public officers." The term public officer is limited to persons appointed by the Governor and executive department officials. Thus, if you serve in an elected office (i.e., Trustee of Michigan State University, Regent of the University of Michigan, or Governor of Wayne State University) the provisions of the Ethics Act do not apply to you. 8 �substantial conflict of interest, the most common of which are listed below: 1. Contracts between the state and corporations where the interested party (state officer) owns less than 1% of the stock in an unlisted corporation or, if the corporation is listed on a stock exchange, the value of the stock is less than $25,000. 2. Contracts between the state and corporations, partnerships or unincorporated associations where the interested party: owns more than 1% of the stock in an unlisted corporation or, if the corporation is listed on a stock exchange, the value of the stock is ~ $25,000; or is a partner in the contracting firm or a member or employee of the unincorporated association; or is a director, officer or employee of the corporation; but only if the interested party does not solicit the contract, takes no part in the negotiations for, or in the approval of the contract or any amendment thereto, does not in any way represent either party in the transaction .and the contract is not with or authorized by the department or agency of the state with which the state officer is connected. 3. Contracts awarded to the lowest qualified bidder as the result of a sealed bid (this exception does not, however, apply to amendments or re-negotiations of such contracts, nor to additional payments that were not authorized by the contracts at the time of award). If the contract does not fall within one of the above categories it should be assumed to constitute a substantial conflict of interest. You will note that the above-cited provisions would prevent a firm, corporation or association in which you are a partner, member, director, officer or employee from contracting with the department or agency with which you are connected in your official capacity. 9 v �5. 6. Q: May a member of my immediate family be a party to a contract with the state that I am prohibited from holding directly? A: The statute provides that a state officer shall not be interested, "directly or indirectly" in any contract with the state that causes a substantial conflict of interest. Thus, you should not seek to do through a relative what you are prohibited from doing yourself. Contracts that you are prevented from holding should, therefore, not be held by your spouse. Contracts held by other relatives are probably acceptable as long as you do not share in the profits directly or indirectly. Q: Am I subject to the provisions of the Lobby Act? A : If you are a member of any of the boards or commissions listed in Addendum I, the provisions of the Lobby Act (MCL 4.411 et seg.) govern your contact with lobbyists or lobbyist agents. 7. 8. Q: If I am covered, what am I prohibited from receiving from a lobbyist? A: The Act provides that a lobbyist or lobbyist agent shall not give you a gift or loan, other than a loan made in the normal course of business. Q: What constitutes a "gift"? A: The Act defines a "gift" as: [A] payment, advance, forbearance, or the rendering or deposit of money, services, or anything of value which exceeds [$36.00] in any 1-month period, unless consideration of equal or greater value is received therefor. Gift does not include: A breakfast, luncheon, dinner, or other refreshment consisting of food and beverage provided for immediate consumption. You may not accept items the value of which exceeds $36.00 in any onemonth period. You may accept food and beverage provided for immediate consumption. Loans from lending institutions and gifts from your immediate family are also excluded from the definition of gift and may be accepted. 10 �9. Q: What penalties might I incur if a violation of the Lobby Act occurs? A: The Act places all penalties for violations of the Act on the lobbyist or lobbyist agent who gives an illegal gift. Thus, the only direct penalty you will incur is embarrassment to yourself, your family and the administration. 10. Q: A: 11. Q: A: 12. Q: A: What if I am not covered by the Lobby Act? If the Lobby Act does not cover your official position, then you are not subject to the Act's restrictions. Keep in mind, however, that the same penalties that can befall a covered official (e.g., personal embarrassment and embarrassment to the administration) can also befall you if you are involved in any untoward conduct involving lobbyists. May I receive gifts from non-lobbyists? The State Ethics Act (MCL 15.341 et seq.) states that "[a] public officer... shall not solicit or accept a gift or loan of money, goods, services, or other thing of value for the benefit of a person or organization, other than the state, which tends to influence the manner in which the public officer ... or another public officer ... performs official duties. Under what circumstances can a gift be accepted? In a series of advisory opinions, the State Ethics Board has established a two-prong test to determine whether the acceptance or solicitation of a gift or other thing of value is proper. The gift must satisfy both prongs of the following test: 1. The gift must benefit the state. 2. The gift must not influence the officer's performance of official duties. Board opinions have generally found it acceptable for public officers to accept reimbursement for expenses incurred pursuant to employmentrelated travel from a non-lobbyist so long as no duplicate payment is made to the individual. Keep in mind that if you serve on one of the boards or commissions listed in Addendum I a lobbyist may not give you a "gift." There are certain limited circumstances, however, under which a lobbyist may pay for travel expenses related to your official duties. You are advised to consult the office of the Governor's Legal Counsel before accepting reimbursement for travel-related expenses from a non-state entity or any other gift of potentially questionable propriety. 11 �13. Q: A: 14. Q: A: 15. Q: A: 16. Q: A: May I receive honoraria? The Ethics Board has determined that state officers may not accept honoraria for their own benefit. There is conflicting Ethics Board authority when the state officer accepts the honorarium with the intent to donate it to the state. Given the conflict it is advisable that you not accept honoraria under any circumstances. The Lobby Act's restriction on gifts also prevents a lobbyist from paying you an honorarium if you serve on one of the boards listed in Addendum I. Are there limitations on my use of information obtained in the course of my official duties? Yes. The Ethics Act prohibits a public officer from divulging to an unauthorized person confidential information prior to the time prescribed for its authorized release to the public. Are there restrictions on the public expression of my views on matters of public policy? The Ethics Act provides that a public officer shall not represent his or her personal opinion as that of an agency. This prohibition does not prevent you from expressing your opinion on matters of public concern. You should not, however, state that your opinion is that of the agency, board or commission on which you serve when such is not the case. Are there restrictions on my use of state property? The Ethics Act provides that public officers are to use personnel resources, property and funds under their official care and control judiciously and in accordance with prescribed procedures and not for personal gain or benefit. 17. Q: -· Are there any other restrictions placed upon business transactions I may wish to engage in? A: Yes. The Ethics Act prohibits a public officer from engaging in a business transaction in which the public officer may profit from his or her official position or may benefit financially from confidential information the public officer may obtain by reason of his or her official position. If you have questions regarding a particular transaction, you should contact the office of the Governor's Legal Counsel for guidance. 12 �18. Q: A: Are there restrictions on my employment due to my official position? Under certain circumstances you may be prohibited from accepting employment or rendering services for a private or public institution when it is incompatible or in conflict with your official duties or may tend to impair your independence of judgment or action in the performance of your official duties. If you have questions regarding employment or services you may wish to render, you should contact the office of the Governor's Legal Counsel for guidance. 19. Q: May I participate in decisions affecting a business entity in which I may have a financial or personal interest? A: Except under certain circumstances, you are prohibited from participating in decisions relating to a business entity in which you have a financial or personal interest. If you have questions regarding official action that may affect a business entity in which you have a financial or personal interest you should contact the office of the Governor's Legal Counsel. 20. Q: A: Are there restrictions on holding other public offices? Yes. The incompatibility of office statute prevents a public officer from holding two or more incompatible offices at the same time. Incompatible offices are those which result in any of the following: (i) the subordination of one public office to another; (ii) the supervision of one public office by another; or (iii) a breach of duty of public office. If you already hold or are considering appointment to another public office, you should consult with the office of the Governor's Legal Counsel. 13 V ~ �GOVERNMENTAL IMMUNITY FROM TORT LIABILITY 1. Q: What is the extent of my liability in tort for actions I take in my official capacity? A: Section 7 of Michigan's governmental immunity statute, MCL 691.1407, affords you broad immunity from tort liability. Generally, the Act provides that each member of a board, council, · commission, or statutorily created task force of a governmental agency shall be immune from tort liability for personal injury or property damage the member causes while in the course of service if: 1. The member is acting or reasonably believes he or she is acting within the scope of his or her authority; 2. The governmental agency is engaged in the exercise or discharge of a governmental function; and 3. The member's conduct does not amount to gross negligence that is the proximate cause of the injury or damage. "Gross negligence" is defined as conduct so reckless as to demonstrate a substantial lack of concern for whether an injury results. Whether you acted within the scope of your authority while in the exercise or discharge of a governmental function, and whether or not you were grossly negligent, can become factual questions during the course of litigation. This means that it may be necessary for you to participate in the defense of lawsuits brought against you or the board upon which you serve in order to establish sufficient facts to obtain the dismissal of such actions. Keep in mind that a key factor in any such litigation will be whether or not you acted within the scope of your authority while discharging a governmental function. This can become a key issue in actions for libel, slander, tortious interference with contractual relations or other intentional tort causes of action. If you have questions about whether an action you may be planning to take in your official capacity or a statement you may wish to make is within the scope of your authority, you may wish to consult with the office of the Governor's Legal Counsel or the Attorney General's office. 14 �2. A: The Attorney General's office will, except in rare circumstances, provide you with legal representation in actions arising from your official duties.
