I have put together some briefing materials to give you an idea of where the membership stands today. Enclosed you will find: 1. A membership chart detailing commissioners by position represented, name of commissioner, term expiration by year, any committees upon which they serve, and declared political affiliation (if known). 2. Two separate rosters that list the commissioners in more detail including their addresses and phone numbers. 3. The official attendance account for each commissioner. 4. A copy ofPA 219 (the law that codifies MCSC and lists the required positions). 5. Our current conflict of interest form. At our next Executive Committee meeting (August 18, 1998) I would like to discuss: 1. The current status and make up of the Commission's membership. 2. The need for a more focused and tailored approach to removing inactive members while gaining new members for specific purposes and with specific skills and/or influence. 0. Welcome and Introduction -Chairperson Engler The meeting was called to order at 1:00 p.m. by Chairperson Engler. There was a brief introduction of the commissioners for the new members of the commission. II. Review of February 13, 1998 Minutes -Chairperson Engler A motion was made by Commissioner Brandell to approve the February 13, 1998, meeting minutes. Commissioner Tate seconded the motion and the minutes were approved. Motion passed unanimously including the approval of the commission members on the phone. III. Program Updates a. Governor's Service Awards- Lindy Reurink MCSC received more than 400 nominations for the Fifth Annual Governor's Service Awards. We anticipate more than 1,000 individuals will attend the awards dinner. The emcee will be Sheri Jones from WLNS TV 6 in Lansing. In addition to the 15 Governor Service Award categories, we will also be announcing the winner of the Russell Mawby, Blue Cross/Blue Shield Sapphire, and Michigan Campus Compact Outstanding Community Service awards. The reception for the nominees held at the residence is at 5:30p.m. Dinner begins at 7:00p.m. at the Lansing Center. b. Volunteerism SuperConference - Lindy Reurink We anticipate 1,200 people will attend the second statewide Volunteerism SuperConference. Keynote speakers will include David Sawyer, Jody Kretzmann, Marcia Bullard, and General Colin Powell. There will be more than 60 workshops at the conference, including an America's Promise track. The Governor and Chairperson Engler will both be attending and speaking at the conference. On May 3, MCSC will host a pre-conference National Service Reception at the East Lansing Marriott. Staff, members, and participants from each of Michigan's national service programs have been invited. Commissioners are also invited to attend. c. Statewide Public Land Cleanup Project - Lindy Reurink May 8 - 17, 1998 marks the first ever MCSC Statewide Public Land Cleanup project. The project partners MCSC with the Department of Natural Resource (DNR), Department of Environmental Quality (DEQ), United States Forest Service (USFS), Michigan United Conservation Clubs (MUCC), and Adopt A Forest (AAF). MCSC will host five overnight cleanup sites that will accommodate 400 Michigan's AmeriCorps staff and members participating in the annual Michigan's AmeriCorps Signature Service Project. In addition, there are more than 5,500 volunteers scheduled to participate in one-day cleanup projects in 72 of Michigan's 83 counties. We estimate that 1,200 cubic yards of trash will be cleaned from 186,710 acres of public land. Overall, this project has been a wonderful experience; exposing MCSC to the realm of environmental volunteerism. We have been able to establish good relationships with DNR, DEQ, USFS and a multitude of environmental volunteer groups. A special thank you to Robin Lynn Schultheiss and other members of the Michigan Nonprofit Association for agreeing to facilitate the Michigan's AmeriCorps Signature Service Project trainings and to Dow Coming for supplying trash bags for the cleanup. 2 �IV. d. Adopt A Part of Michigan - Lindy Reurink The purpose of the campaign is to make people aware of the three statewide adoption programs and encourage additional volunteers to participate in the programs. To support this effort, MCSC has installed a 1-888 toll free phone number and has developed a series of Adopt A Part of Michigan posters and brochures. Hundreds of the posters and brochures have been sent to state parks, United States forest offices, state harbors, state marinas, Chambers of Commerce, Secretary of State Offices, local DNRIDEQ offices, etc. In addition, this fall the posters and brochures will also be sent to schools and higher education institutions. Jocelyn Yanda suggested that we send the poster to state department directors. c. America's Promise in Michigan- Paula Kaiser Ms. Kaiser discussed Calhoun County's launch. Ms. Kaiser then passed out Michigan's Promise key dates and activities and also Michigan's Promise- The Alliance for Youth Questions and Answers. Ms. Kaiser went on to explain the reason for changing the name "America's Promise in Michigan" to "Michigan's Promise". There was some discussion regarding Retired General Powell participation in the Calhoun County launch and the Mackinac Island Business Leader Luncheon. Commissioner Orosz and Bonnie Graham gave some suggestions on an evaluation system. Commissioners Newport and Brandell discussed their local launches. Executive Director's Report and Status Update- Vice Chair/Interim Executive Director Terry Pruitt a. Staff Update Commissioner Pruitt introduced the newest member of the Michigan Community Service Commission (MCSC) staff, Maria Garcia, Communications Coordinator. Maria Garcia gave a brief description of her professional background. b. Unified State Plan Commissioner Pruitt had an overhead presentation which described the background of the plan, listed the partners, gave the vision statement, goals, and the current action plan. c. Executive Director Search Commissioner Pruitt announced to the commissioners that Mr. Kyle Caldwell will be the new executive director of MCSC. He is currently employed with Olivet College and will start on May 4, 1998. Commissioner Pruitt will stay on as interim executive director to the commission until May 11, 1998. He would also like to remain active with some of the current projects such as the Unified State Plan and the Volunteer Investment Grants. Commissioner Pruitt was thanked for his service by Mary Pfeiler, Commissioner Orosz, and Chairperson Engler. d. Volunteer Investment Grants Tabled until future meeting. 3 �V. New Business (Action Items) a. Approval of the Michigan's AmeriCorps Formula Proposals - Cynthia Hedden There are two parts to the Michigan's AmeriCorps packet- new programs and renewal programs. The first is the new formula AmeriCorps programs to go on to the Corporation for National Service. Commissioner Pruitt proposed that the four new programs be approved as one packet. MCSC received 17 Concept Papers. Eleven of them were recommended by the peer review. Out of the 11 only 7 were recommended by staff to submit a Comprehensive Proposals, of the 7 that submitted Comprehensive Proposals, the staff is recommending 4 for funding. Those four include: Rural Strategic Action Initiative, Creston Neighborhood Association, UnderGround Railroad, Inc., and Charlevoix-Emmet lSD. Commissioner Orosz and Brandell asked questions before there was a motion to approve the staff recommendation by Commissioner Newport and seconded by Commissioner Smith. The motion carried by those in attendance and by commissioners Wesaw, Neelis, and Lenz via phone. Ms. Hedden discussed each AmeriCorps renewal application briefly. Commissioners Orosz, Smith, Newport, and Brandell had questions which were answered by the MCSC staff. Chairperson Engler motioned to approve the AmeriCorps renewal package as a group. Commissioner Muir supported the motion and the motion was seconded by Commissioner Orosz. Commissioner Tate and Chairperson Engler abstained from voting on the Michigan Nonprofit Association's proposal. Chairperson Engler also abstained from the Michigan Communities in Schools proposal vote. The proposals were passed by those in attendance and also by Commissioners Wesaw, Neelis, and Lenz (via telephone). b. VI. Approval of AmeriCorps Compelling Circumstance Waiver PolicyVice Chair Terry Pruitt The purpose of the waiver is to aid Family Independence Agency AmeriCorps members under the state's welfare reform to find permanent full-time employment. This waiver will allow them a pro-rated education awards if they complete at a minimum, 50% of the first year of service, or 15% of the second year. This will also apply to members, who are Family Independence Agency clients in programs other than the Citizen's Health Service Corps. Commissioner Tate made a motion to approve the waiver. Commissioner Newport seconded the motion. The waiver was approved by those in attendance and by commissioner Wesaw, Neelis, and Lenz via phone. Your feedback was very helpful and will help make for a productive September MCSC meeting. The following is a summary of our discussion. 1. Modifications to the Volunteer Investment Grant (VIG) Procedures The Executive Committee reviewed the draft memo for VIG modifications. They agreed with the rationale for most of the modifications, but would like to change some of the wording to ensure that VIG meets both its programming and financial objectives. Current recommendation #3: "If a program applies for the maximum amount of the grant for three consecutive years, then they would only be able to apply for the minimum amount in the fourth and following years that the grants are available." Modify recommendation #3 to read: 3. In addition to the current review criteria, the Request for Proposal will note that the overall pool of proposals will be evaluated on their overall strengths and on the proposal ' s ability to provide the greatest possible demographic and geographic diversity (i.e. rural/urban, median household income, etc.). �Executive Committee Meeting of August 18, 1998 Discussion around this point highlighted that MCSC may want to stay away from the restrictions that a cap might create and instead, look at demographic diversity or "balancing criteria." The Committee was concerned that if MCSC capped the number or size of grants it might have to return unexpended funds due to a lack of participation. This proposed modification offers the greatest flexibility and enables MCSC to ensure the quality for the V/Gs and the full utilization of the state appropriated funds. Current recommendation #5: "The match level be modified." Modify recommendation #5 to read: 5. Modify the current 2:1 match level to one of a sliding scale that takes into consideration the number of times an applicant has successfully applied for and operated a VIG. For example: • First year applicants would be required to raise $1 in local endowment funds for every $1 of State of Michigan funds requested through VIG. • Second year applicants would be required to raise $1.50 in local endowment funds for every $1 of State of Michigan funds requested through VIG. • Applicants in their third year and beyond would be required to raise $2 in local endowment funds for every $1 of State of Michigan funds requested through VIG. Finally, staff will need to examine how they ensure that one community foundation is not placed in the awkward position of hosting two competing VIG endowments for two separate agencies in the same "community." 2. MCSC's Four-Year Plan for Development & Transition Recommendations of MCSC Staff The committee members discussed that the draft copy of the MCSC Four-year Plan for Development and Transition provides a fairly accurate and concise historical context for the MCSC. The plan, however, fails to emphasize a rather critical component-collaboration. In fact, MCSC' s very existence is almost totally dependent on its relationships with other organizations and individuals. While collaboration is mentioned in parts of the plan, it does not "take centerstage" as might be expected. Collaboration should be moved to the very front of the plan and be a major topic. Committee members suggested that the plan should discuss how MCSC will strive not only to reinforce existing relationships, but also how it will seek out new and untraditional partnerships with charitable and other various profit and nonprofit organizations. These relationships need not always highlight MCSC as the focal point so long as "the good work gets done." Finally, the plan needs to celebrate and demonstrate its immense pride in the relationships it has forged and will use that pride to foster a new era of partnership development. Page 2 �Executive Committee Meeting of August 18, 1998 Committee members wanted to know what action(s) should be taken at the September meeting concerning the plan. The Executive Director explained that the staff would be working to further develop this plan to include a draft timeline and budget in preparation for commissioners to review at the September meeting. At the September meeting, staff will request feedback and suggestions on the principles articulated in the plan and ask that commissioners approve a final version at the December meeting. Unless commissioners express significant reservations concerning the plan, staff will continue to develop it while incorporating their feedback. The Executive Committee suggested that the Executive Director give a brief and concise summary of the plan highlighting the over arching goals and explaining the impact of this plan on the service and volunteerism field. Committee members also emphasized the need for a presentation of the historical context (much like the one articulated in the plan) as an orientation tool for other commissioners. 3. MCSC's Utilization of Commissioner Developing a Trusteeship Committee/Process Committee members strongly agreed that Mrs. Johnson's idea of forming a standing committee for membership development was a logical fit for MCSC. Committee members discussed that the current process (giving general suggestions to the Governor's Appointments Office) was insufficient. In addition, MCSC needs to review MCSC' s current appointments, each commissioner's assigned representation role (as required by both Michigan and federal laws), individual commissioners' participation levels, and each commission member's standing committee assignment(s). To facilitate this process, committee members decided to recommend the establishment of the Board Development Committee. This will be a standing committee of MCSC and will serve to build a "pipeline" for new commissioners, determine appropriate committee assignments, and deal with inactive members. There are no rules or procedures in the MCSC Operating Procedures nor in PA 219 that deal with the establishment of standing committees for MCSC. According to the MCSC minutes of the July 24, 1992, commissioners adopted the current standing committee structure as part of the MCSC Operating Procedures. Therefore, as set in precedent by the vote of the 1992 meeting, the Executive Committee recommends that, at the September, 1998 meeting, MCSC add the Board Development Committee to its current roster of standing committees. The membership shall include the Chairperson and at least one other Executive Committee member. Specific tasks and roles will be defined at a later date. The Executive Committee also discussed the general appointments process. Specifically, several commissioners' terms will expire October 1, 1998. The Board Development Committee will meet and make recommendations to the Governor as one of their first tasks. Page 3 �Executive Committee Meeting of August 18, 1998 4. MCSC Proposed Staffing Changes Based upon the recommendations of Commissioner Pruitt (while serving as Interim Executive Director) and the observations of the inner workings of the MCSC office by the current Executive Director, a three-division supervisory tier structure was set in place. This structure consists of three primary areas: Outreach and Fund Development, Programming, and Finance and Administration. These functions areas are not new to MCSC. In fact, you will find these three areas illustrated in previous versions of the MCSC organizational chart. However, placing someone with sole responsibility for each of the areas is new. In addition, there are increases to the number of staff that would support the work of MCSC. These proposed changes were reported in the latest Executive Director's Report. Some concern was raised about informing the full Commission prior to making such fundamental changes to the way the MCSC operates. The Executive Committee asked that the Executive Director present these changes and the rationale for making them at the September meeting. 5. Other Items ACE Program The Executive Committee discussed the progress of incorporating the ACE program into the MCSC portfolio. The Executive Director explained that the plan is still "in the works." However, Ms. J. Ellis has been assigned a number of additional MDE duties and since the ACE program is heavily dependent on her relationships with key organizations, the MCSC will continue to work with the Michigan Department of Education to find the right time and the right fit for the program. The Executive Director will deal with this issue at the September meeting in the Executive Director's Report. Make A Difference Day Members of the Executive Committee discussed a genuine interest in involving commissioners in a concentrated and quality volunteer service experience on Make A Difference Day. Commissioner Pruitt mentioned that it would be a genuine and significant way for MCSC to show that it "practices what it preaches." The Executive Director will work with Mrs. Lindy (Reurink) Lange to see if there are any key opportunities in the Lansing area on October 24, 1998 that would work to facilitate this interest. Having spent the past seven months supervising the staff and agency operations, I believe now is the right time to consider structural changes to the organization. These suggested changes will improve administrative decision-making and overall program management. Your examination and feedback pertaining to the ideas presented here would be greatly appreciated. To begin, it is important to note that MCSC has a significant leadership role in supporting volunteer initiatives throughout the state as well as the nation. There is no question that MCSC continues to be recognized as one of the premiere state commissions in the country. The level of responsibility and credibility of the commission staff has also been heightened over the past few years. Funding for the commission has nearly tripled over the past five years and the number of programs being funded has expanded by more than 200% in the same period. I am pleased that we were able to upgrade the position of the Executive Director with Kyle's appointment. This recent action properly recognizes the level of responsibility and authority defined for this position. Secondly, it assures that we are in a much stronger competitive situation in our ability to secure a capable manager in the future should the need arise. Much of this rationale also applies to the other administrative employees on the commission staff. We've developed a very dedicated, competent administrative team with duties and responsibilities that, in my opinion, significantly exceed their current job classifications. Briefly stated, commission staff are required to have extensive knowledge of Corporation for National Service programs, federal rules and policies, grant writing skills, program management, technical Dow Corning Corporation l\Iidland, Michigan 48686-0994 Phone: (317) 496-lOOO �assistance and program evaluation, fiscal management skills, project design and planning skills and effective communication skills. In addition, these individuals must serve as a liaison to community organizations, provide training assistance to grantees, and conduct various workshops and conferences. The following recommendations seek to constructively address these matters. Recommendations In short, I have proposals that address two specific areas. First, I'm proposing a series of internal structural changes aimed at improving accountability and overall efficiency within the agency. Secondly, I've developed a series of recommendations for upgrading positions Gob levels) for commission administrative staff that provide a greater level of recognition for the work that is required by these individuals. Let me acknowledge right up front that I realize that much of what I'm proposing must be implemented within the State's Civil Service policies. My hope is that we, can find a way to move forward without having the civil service rules be so limiting that we not do what is in the best interest of strengthening the administrative leadership and organizational capacity of the MCSC. In the end, the citizens of the State ofMichigan will be the real winners by virtue of a more effective and capable staff to address their needs. One final point here, currently all administrative staff report directly to the Executive Director (Kyle Caldwell) with the exception of the Department 9 Analyst (Maria Garcia), who reports to Lindy Reurink (Department Analyst 12). All support staff now report to Mary Estrada (Executive Secretary II). The structural changes I'm proposing will substantially alter the lines of authority and accountability within the organization. These recommendations will most directly affect the commission's administrative personnel and only minimally affect the support staff Please review the following: 1). All MCSC programs and activities would be managed under one of three organizational components: A Community Services Component, Special Services Component; and a Administrative Services Component. The attached organization chart depicts the specific areas of activity/responsibility and staffing for each of the functional components. The Community Services Component would be headed by Paula Kaiser and would essentially be responsible for all programming activity involving external grantee organizations including management of the RFP process, federal, state, and foundation grant application development, program reporting systems, program coordination, etc. This part of the organization would have full responsibility for CNS AmeriCorps Programs, MI Cares, Volunteer Investment Grants, Learn & Serve, America Reads, Michigan Reads, ACE Program and America's Promise. The Special Services Component would assume responsibility for all internally driven projects and programming initiatives. This would specifically include all communication and public relations activities (i.e. MCSC Annual Report, Quarterly Newsletter, Special Publications, Web-page development and management), Governor's Service Awards, Make A Difference Day Activities, Grantee and Staff Technical Assistance Programs, Senior Advisory Council, and MYP AC. Lindy Reurink would manage the staff and activities in this area. 2 �Finally, the third organizational component would be focused around key administrative services including grant administration, fiscal planning and management, personnel liaison and procurement activities. This area would be headed by Gary Gross. The three managers of these functional components would report directly to the Executive Director as will the Executive Secretary II. BUDGET IMPACT The recommendations presented here need to be carefully analyzed for their potential impact on the current commission budget as well as the next fiscal year budget. However, my preliminary review of the agency's available and expected fiscal resources suggests that these changes can be accommodated without jeopardizing major program initiatives or important services. On average, position upgrades can be accomplished with a salary adjustment of between $5,000-7,000 (including retirement) in each situation. The majority of the funding for the proposed adjustments would come from federal funding sources. This shortage of data was highlighted during the creation of our most recent annual report. We were limited in our ability to describe the leadership of our organization because of the scarcity of data available. At our next meeting, I would like to suggest that we invite all commissioners to submit biographies, resumes and a photograph (head shot) of themselves for our general files. MCSC is mandated by law to ensure that the Commission is politically diverse. Specifically, the National and Community Service Trust Act of 1993, Sec. 178 (d), and the Michigan 1994 Public Act No. 219 Sec. 3 (5) state that the chief executive officer of a state (the governor) shall ensure, to the maximum extent possible, that the membership of any state commission is diverse with respect to race, ethnicity, age, gender, and disability characteristics. Not more than 50 percent of the voting members of a state commission. plus one additional member. may be from the same political party. Unfortunately, the only way MCSC can accurately and discretely determine political affiliation is to quietly poll our members. Given the proximity to the upcoming election coupled with the desire to avoid any perceptions of imposing undue influence, I do not think that this polling should take place at the September meeting. However, it will be important to ensure that we are in compliance with the aforementioned laws. I would like to suggest that we mention our need for political diversity at the September meeting. After that meeting we can distribute the Political Party Diversity Verification Form via mail requesting that it be returned at the December meeting. Twenty-one grants were awarded in the initial round to twenty-one agencies for a total of $936,500. In addition, $28,500 has been requested by grantees in the second round of awards. (*Please send second bullet point below.) By the end of this year's VIG, it is expected that $965,000 will have been awarded. This means that at minimum $1,930,000 will have been raised locally and endowed permanently to create and sustain local volunteer resource activities. As of August 15, 1998, VIG grantees have raised and endowed $862,967 and MCSC has awarded $409,500 to the local grantees. Since awarding grants in February 1998, staff have learned a lot about how to improve and streamline this grant process. Over the course of the last few months staff solicited, both formally and informally, ideas and recommendations from grantees and statewide partners like the Volunteer Centers of Michigan, United Way of Michigan and the Council of Michigan Foundations. The following recommendations were gleaned from our many conversations with the field, as well as lessons learned by the MCSC staff. MCSC staff would like to present the following changes for Commissioner's review and approval. 1. VIG is funded through state dollars. In FY 98, the grants were issued in February, four months after the fiscal year (state fiscal calendar runs October 1 -September 30). This creates some problems in ensuring that all monies are dispersed by the end of the fiscal year. Therefore, the staff would like to recommend that the grant start dates be moved back one month every year until they coincide with the start of the fiscal year (October). If this recommendation is approved, the application process would need to be adjusted. For FY99 the staff would make the VIG Request For Proposal available in mid September. The applications would be reviewed in November and presented to the Commission at the December meeting. �FY 1999 Volunteer Investment Grant 2. In FY 98, VIG recipients were allowed to request a minimum of $25,000 and a maximum of $75,000. During the first round of applications in FY 98, MCSC awarded $936,500. Because these are state funds, it was important to award the full one-million dollars, therefore staff issued a second RFP to existing grantees. The only stipulation of the second application process was that the grantee may not request more than the $75,000 maximum. If they requested the full $75,000 in the first application, they were not eligible to apply in the second round of funding. Through the second RFP MCSC will award $28,500 bringing the total FY98 awards to $965,000. Unfortunately due to the cap of $75,000 one of the current grantees that applied for the full $75,000 and had already generated the entire 2 to 1 match, wanted to apply for additional funds and could not. Had the maximum amount of the grant been greater than $75,000, that applicant would have been eligible to apply for additional funding. Therefore, in FY99 the staff recommends that the minimum amount remains $25,000 but that the maximum level be raised to $100,000 thus allowing agencies to request higher funding levels and increasing the likelihood that the full onemillion dollar state allocation will be expended. 3. In addition to the current review criteria, the RFP will note that the pool of proposals will be evaluated on their overall strengths and on the proposal's ability to provide the greatest possible demographic and geographic diversity (i.e., rural/urban, median household income, etc.). 4. In reviewing the VIG requirements, there is some concern over the type of endowment required by VIG recipients. In FY 98 VIG recipients were required to endow the match dollars in an agency designated fund. MCSC staff recommend that the RFP be modified to include language that clearly articulates that the purpose of this endowment is the development of permanent funds, the earned interest of which will remain a constant source of revenue for agency operations. In order to better ensure that these monies be used in the spirit in which they were intended, staff recommend that local community foundations endow any VIG designated funds in a board designated endowment rather than a multipurpose agency designated endowment. This change in wording will help to eliminate any confusion and ensure that agencies use VIG matching funds in a manner that is in keeping with the mission-to develop endowments for purposes of recruiting, training and placing volunteers in their local communities. 5. Lastly, MCSC staff recommend that the MCSC review and revise the required match levels for VIG. In FY98, recipients were required to produce a $2 match for every $1 provided by VIG. In discussions with grantees and statewide partners, staff heard consistently and clearly that in the absence of Romney Fund dollars, a two dollar match will be extremely difficult and that any future applications from current agencies would be highly unlikely. 1/14/98Page 2 �FY 1999 Volunteer Investment Grant Therefore, MCSC staff recommend and seek MCSC approval for the following modifications to the Volunteer Investment Grant program for FY99 and beyond: 1 . The answers are simple and proven. uf;~~ • Service and volunteerism remain [as always] the truly sustainable and e~during forms of problem solving. • With service and volunteerism, there are no barriers of class, age, race, income or religion-most anyone can contribute. • The process of developing a volunteer or service experience in one's community, in and of itself can bring all of us closer together. Enduring Forms of Problem Solving People and organizations taking responsibility for their own community as well as for themselves is the only long-term solution to many of our community ills or woes. No one organization or individual can do it all nor should they. Much as each giving act is unique and valuable, so to are the individuals and organizations who take the necessary steps to meet genuine needs. There is a place for everyone. Each act forms a "patch" of a quilt that constitutes the various sectors of our society. Whether you label them the public, private, profit or social sectors, �''Golden Rule" by providing aid and . .. comfort to the most needy. Nonprofits are one of this nations' rapidly growing industries. Michigan alon(~~h~ld ;y)-- claim to some of the world's largest foundations and the largest regional association of grantmakers. The United Way in Michigan has a strong presence in almost every community in the state and community foundations now serve nearly every county. Human service agencies like Focus Hope in Detroit and the Children's Museum in Marquette are growing and expanding. Training and technical assistance organizations geared toward helping to develop leadership and instill proven business practices in nonprofits are cropping up everywhere to meet this growing demand. And yet, even with all of this growth, there is still far more demand than what these nonprofits are capable of addressing. Many nonprofits live "hand to mouth" skipping from one grant to another without any real stable funding base. Their constituents are often unable to provide financial support so the "please the customer because the customer is paying" philosophy of the profit sector doesn't apply. Nonprofits are now relying on other nonprofits for their survival. Fortunately, generous support by traditional philanthropic organizations (foundations, f �United Ways, etc.) to man~"i.WOfits is. • buttressed by that of many for-profit organizations. The "Big Three" automak1 wings and two have their own volunteer ·•.· The Foundation Center's Database lists centers for employees to give over 1,380 Michigan-based grantmaking:~~i~~~z;~1;i~n~. }Yhile this can appear as an overwhelming amount of support availabl;;ma.ny~onprofits find thaHhe funding through these ,.>f~:: · r~1~:: organizations is restricted either geographically~~ by C'!l:!~" Nott:Pr6fits with a specific mission ,.,·, ., c::~lfi:~;x ~:;c, that is focused and targeted find it difficult to find funding that interests of the funder. Government has driven much change in society, or some might say, has followed th~,~tlri.:v~ <.(1/c .•. of society's need to change. In either case, government has leveraged both money and la~zia~ard meeting critical and genuine needs. Government is credited for lifting the nation out ofittV~ financial and social depression during the early part of this century. Government heard the call of many during the Civil Rights Movement and made laws and funded programs to bring a sense of equity to the workplace and to the liberties of all our nation's peoples. Now, however, we find government at the forefront of reforming the aforementioned programs and now works toward returning responsibility for our own community to our own communities. Government has placed service and volunteerism back on the nation's agenda with new national service initiatives. Government is credited with all of these things, but still is unable to make the key, core and fundamental change necessary for all of our citizens to prosper in the communities in which they live. Government, in much of the public view, is now often credited with being more of a hindrance than any type of help. Yet, it is government, with its extensive financial resources and multifaceted experiences and views, and tremendous political power that can leverage resources and write rules that focus societies' attention on itself. �v;" :;A .. ' It is truly the work qt-fthese provide the support and elements to our society-our patch work quilt-that 2~J: to is a fundamental belief that we "and those needing to give. And at their core " ~1hh~ty f(;)r our community-for our own mending. v<>:: Throughout time we have seen that the:. /)j¥:~<:~ :6f:~~~~:'~d not just organizations are what make the difference over the long haul. Few Barriers Acts of service and volunteerism recognize few barriers;:~meo, { ; ' -:v·C ; \FQlunteetXfegardless ;:<r> , .. of class, age, income, race or religion. The only barriers are our willingn~s, our courage, our imagination and our abilities. All of these are centered within each of us and not within s pressures. A high school student from inner-city Detroit can take time to help tutor am , elementary student in reading. A retired school teacher can volunteer their time in the classroom to mentor the next generation of teachers. A factory worker can serve on the board of their local United Way. A family can spend time together to serve meals at a local soup kitchen for the homeless. A retired entrepreneur can donate their business knowledge and skills to developing nonprofits. Anyone can do it. In his book, "Who Speaks for God," Reverend Jim Wallis calls on everyone to develop a new approach to our philanthropic spirit. It [new approach] will call for a heightened level of volunteer activity from every sector of society-both the energy of young people and the expertise of older generations. Dr. Martin Luther King Jr. once said that anyone can be great because anyone can serve. And the deep reflective process that follows a quality experience builds a legacy for others to emulate. It is often the process that makes the greatest impact on all parties involved. Michigan has engaged in such a process and has experienced, first hand, the power of coming together to solve a problem. Building the Patchwork Quilt In its wisdom, the philanthropic field in Michigan came together (at the W.K. Kellogg Foundation) in 1991 to ask some very fundamental questions concerning volunteerism in the state. State and local organizations from across Michigan came together to talk about their perceptions on what Michigan needed and what Michigan was doing. Out of that discussion, in conjunction with several subsequent ones, grew the idea of a state entity to help promote and coordinate service and volunteerism in Michigan. Again wisely, Governor Engler appointed a commission to deal with this issue and �Mrs. Michelle Engler w, as its chair. Since its creation by executive order ice C~bunission (MCSC) has served as a c/, convener, catalyst and broket , f cotp;munity problem solving through service. It runs through biblical history and it is as contemporary as the evening meal that helps hold a family together, the potluck supper that cements social and spiritual connections, or the special gathering of loved ones that marks a reunion or holiday celebration. It is at the table that we see each other's faces, remind ourselves of the ties that bind us, and rededicate ourselves to who and what we were meant to be. It is also an opportunity to be thankful for what we have so that it might not slip away ......... Only by coming together can we see the possibilities that could begin to move us forward. Anyone can come to the table. If there are not enough chairs, we must find some more. If there is not enough room, we must make the table larger. Even the shape of the table will change as we discover that round tables allow us to see each other better, and on more equal terms, than the old rectangular styles. MCSC has show in its work that it is the only place (the table) where all the patches can come together and make a seamless quilt that covers all the needs of our society and its communities. Similar to when women would bring their scraps of cloth to a common table, plan out what the final_product will be and use their skills, needle and thread to build it together, Michigan has worked to build something special. Emerson and Johnson ENROLLED HOUSE BILL No. 5280 AN ACT to establish the Michigan community service commission; to provide for the powers and duties of the Michigan community service commission; and to provide for the powers and duties of state departments and agencies and certain state officers and employees. The People of the State of Michigan enact: Sec. 1. As used in this act: (a) "Commission" means the Michigan community service commission established in section 2. (b) "Community-based agency" means that term as defined in section 101 of title I, 42 U.S.C. 12511. (c) "Corporation" means the corporation for national and community service established in section 191 of title I, 42 u.s.c. 12651. (d) "National service laws" means that term as defined in section 101 of title I, 42 U.S.C. 12511. (e) "Out-of-school youth" means that term as defined in section 101 of title I, 42 U.S.C. 12511. (f) ''Title I" means title I of the national and community service act of 1990, Public Law 101-610. Sec. 2. The Michigan community service commission is established within the Michigan jobs commission, established by Executive Order No. 1993-2. Sec. 3. (1) The commission shall consist of 21? members appointed by the governor. (2) The commission shall include as voting members, except as otherwise indicated, at least 1 of each of the following: (a) An individual with expertise in the educational, training, and developmental needs of youth, particularly disadvantaged youth. (b) An individual with experience in promoting service and voluntarism among older adults. (c) A representative of a community-based agency. (d) The superintendent of public instruction, or his or her designee. (e) A representative of local government. (f) A representative of local labor organizations. (g) A representative of business. (h) An individual between the ages of 16 and 25 who is a participant or supervisor in a program as defined in section 101 of title I, 42 U.S.C. 12511. (i) A representative of a national service program described in section 122(a) of title I, 42 U.S.C. 12572. (123) �(j) The employee of the corporation designated under section 195 of title I. 42 U.S.C. 12651f, as the representative of the corporation in this state, as a nonvoting member. (3) In addition to the members described in subsection (2), the commission may include as voting members any of the following: (a) Local educators. (b) Experts in the delivery of human, educational. environmental, or public safety services to communities and persons. (c) Representatives of Native American tribes. (d) Out-of-school youth or other at-risk youth. (e) Representatives of entities that receive assistance under the domestic volunteer service act of 1973, Public Law 93-113, 87 Stat. 394. (4) Not more than 6 of the voting commission members shall be officers or employees of this state. The governor may appoint additional officers or employees of state agencies operating community senice, youth service, education, social service, senior service, and job training programs, as nonvoting, ex officio members of the commission. (5) The governor shall ensure, to the maximum extent possible, that the commission membership is diverse with respect to race, ethnicity, age, gender, and disability characteristics. Not more than 50% of the voting members of the commission, plus 1 additional member, shall be from the same political party. (6) Except as provided in this subsection, members of the commission shall serve for staggered 3-year terms expiring on October 1. The members constituting the Michigan community senice commission under Executive Order No. 1993-24 on the day before the effective date of this act shall serve on the commission for the remainder of the terms for which they were appointed. Of the additional members, the governor shall appoint 1/3 for terms expiring October 1, 1995, 113 for terms expiring October 1, 1996, and 113 for terms expiring October 1, 1997. (7) A vacancy in the office of a member of the commission is created in the manner provided in section 3 of chapter 15 of the Revised Statutes of 1846, being section 201.3 of the Michigan Compiled Laws. A vacancy shall be filled by appointment by the governor for the remainder of the term: The vacancy shall not affect the power of the remaining commission members to execute the duties of the commission. Sec. 4. (1) The voting members of the commission shall elect 1 of the voting members to serve as chairperson of the commission. The voting members of the commission may elect other officers from among the members of the commission. (2) The commission shall meet quarterly. However, the commission shall meet more frequently at the call of the chairperson or if requested by 5 or more members. (3) A majority of the members of the commission constitutes a quorum for the transaction of business at a meeting of the commission. A majority of the voting members present and serving are required for official action of the commission. (4) Except as provided in subsection (5), a voting member of the commission shall not participate in the administration of the grant program described in section 7(r), including any discussion or decision regarding the provision of assistance or approved national service positions, or the continuation, suspension, or termination of assistance or such positions, to any program or entity if both of the following apply: (a) A grant application relating to the grant program is pending before the commission. (b) The application was submitted by a program or entity of which a member is, or in the 1-year period before the submission of such application was, an officer, director, trustee, full-time volunteer, or employee. (5) If, as a result of the operation of subsection (4), the number of voting members of the commission is insufficient to establish a quorum for the purpose of administering the grant program described in section 7(r), the voting members excluded from participation by subsection (4) may participate in the administration of the grant program, to the extent permitted by regulations issued by the corporation under section 193A(b)(ll) of title I, 42 U.S.C. 12651d. (6) Subsection (4) does not limit the authority of any voting member of the commission to participate in either of the following: (a) The discussion of, and hearing and forums on the general duties, policies, and operations of, the commission or the general administration of the grant program described in section 7(r). (b) Similar general matters relating to the commission. (7) The business which the commission may perform shall be conducted at a public meeting of the commission held in compliance '"ith the open meetings act, Act No. 267 of the Public Acts of 1976, being sections 15.261 to 15.275 of the Michigan Compiled Laws. 2 �(8) A writing prepared, owned, used, in possession of, or retained by the commission in the performance of an official function is subject to the freedom of infonnation act, Act No. 442 of the Public Acts of 1976, being sections 15.231 to 15.246 of the Michigan Compiled Laws. Sec. 5. Members of the commission shall serve without compensation. However, members of the commission may be reimbursed for their actual and necessary expenses incurred in the performance of their official duties as members of the commission. \ ~ 1j Sec. 6. The commission shall have staff necessary for the commission to perform its functions. The commission staff shall include an executive director. The executive director shall report directly to the governor and the commission for the purpose of giving advice and making recommendations on programs and laws related to volumruism and community service. 1 j l l J ~ i j 1 Sec. 7. The commission shall do all of the following: (a) Ensure that its funding decisions meet all federal and state statutory requirements. (b) Recommend innovative statewide service programs to increase volunteer participation in all age groups and community-based problem solving by diverse participants. (c) Develop and implement a centralized system for obtaining information and technical support concerning voluntarism and community service recruitment, projects, training methods, materials, and activities throughout this state. The commission shall provide the information and technical support upon request. (d) Promote interagency collaboration to maximize resources and develop a model of such collaboration on the state level. (e) Provide public recognition and support of volunteer efforts that address community needs by individuals. by private sector organizations and businesses, and by partnerships between the public and private sectors. (f) Stimulate increased community awareness of the effects of volunteer services in this state. (g) Utilize local, state, and federal resources to initiate, strengthen, and expllllld quality service programs. (h) Serve as this state's representative to national and state organizations that support the commission's mission. (i) Prepare for this state a national 3-year service plan that is developed through an open and public process that provides maximum participation and input from national service programs in this state and other interested members of the public. The plan shall be updated annually and contain information that the commission considers appropriate or the corporation requires. The plan shall ensure outreach to diverse community-based agencies that sen·e underrepresented populations, by either using established state networks and registries or establishing these networks and registries. (j) Prepare this state's financial assistance applications under section 117B of title I, 42 U.S. C. 12543, and section 130 of title I, 42 U.S.C. 12582. (k) Assist in the preparation of th~ department of education's application for assistance under section 113 of title I. 42 u.s.c. 12525. (l) Prepare this state's application under section 130 of title I, 42 U.S.C. 12582, for the approval of service positions that include the national service educational award described in division D of title I, 42 U.S.C. 12601 to 12604. (m) Make recommendations to the corporation with respect to priorities for programs receiving assistance under the domestic volunteer service act of 1973, Public Law 93-113, 87 Stat. 394. (n) Make technical assistance available to enable applicants for assistance under section 121 of title I, 42 L'".S.C. 12571, to plan and implement service programs and to apply for assistance under the national service laws, using information and materials available through a clearinghouse established under section 198A of title I, 42 U.S.C. 12653a, if appropriate. (o) Assist in the provision of health care and child care benefits under section 140 of title I, 42 U.S.C. 12594, to participants in national service programs that receive assistance -under section 121 of title I, 42 U.S.C. 12571. (p) Develop a state system for the recruitment and placement of participants in programs that receive assistance under the national service laws. ..._ -• . !."-· (q) Disseminate information about national service programs that receive assistance under nationru service laws and about approved national service positions. (r) Use assistance provided under section 121 of title I, 42 U.S.C. 12571, to administer this state's grant program in support of national service programs including the selection, oversight, and evaluation of grant recipients. · (s) Develop projects, training methods, curriculum materials, and other materials and activities related to national service programs that receive assistance directly from the corporation or from the state using assistance provided under section 121 of title I, for use by such programs upon request. · 3 �.J Establish policies and procedures for the use of federal funds received under title I or the national service laws. (u) Coordinate its functions, including recruitment, public awareness, and training activities, with any division of the corporation for national and community services. Sec. 8. The commission shall not directly carry out any national service program that receives assistance under section 121 of title I, 42 U.S.C. 12571. Sec. 9. Subject to requirements prescribed by the corporation, the commission may delegate nonpolicymaking duties to a state agency or to a public or private nonprofit organization. Sec. 10. (1) Except as provided in subsection (3), this state assumes liability with respect to any claim arising out of or resulting from any act or omission by a member of the commission within the scope of service of the commission member. (2) A member of the commission shall not have any personal liability for any claim arising out of any act or omission by the member within the scope of the member's service on the commission. (3) Subsection (2) does not limit personal liability for criminal acts or omissions, willful or malicious misconduct, acts or omissions for private gain, or any other act or omission outside the scope of the service of the commission member. (4) This section does not do any of the following: (a) Affect any other immunities and protections that may be available to the commission member under any law applicable to the member's service on the commission. (b) Affect any other right or remedy against the state under any applicable law, or against any person other than a member of the commission. (c) Limit or alter in any way the immunities available for state officials and employees not described in this act. Sec. 11. The commission shall comply with all requirements of federal law, including but not limited to requirements of coordination with other state agencies or with volunteer service programs. Sec. 12. State departments and agencies shall cooperate with the commission in the performance of its functions. The commission may request, and state departments and agencies shall provide, policy and technical information required by the commission in the performance of its functions. Members of the Commission are asked to declare actual or potential conflict of interest situations at the start of each meeting where the agenda indicates such a conflict will occur. If a conflict of interest situation develops during Commission discussion, the Commissioner with the conflict is expected to notify the Chairperson. A conflict of interest is defined as a situation where a member of the Commission or their wife, husband, son, daughter, mother, father, brother, brother-in-law, stepbrother, sister, sister-in-law, stepsister, daughter-inlaw, mother-in-law, father-in-law, son-in-law, aunt, uncle, niece, nephew, grandparents, step parent, stepchild, or grandchild is serving or has served in the last year as a trustee, officer, director, or employee in an entity which is requesting approval of a grant from the Michigan Community Service Commission or any other family or professional relationship which a· Commissioner at his/her own discretion deems a conflict of interest. 2. Any members of the Commission with a conflict will be called on by the Chairperson to explain the conflict. The Commission member will then be excused by the Chairperson while other members of the Commission discuss the application and vote its acceptance or denial as well as other grant applications under the same program. Following action on the grant request, the Commissioner may return to the Commission work. 3. Michigan Community Service Commission members who are unsure about a conflict of interest situation should discuss their concerns with the Chairperson prior to the meeting where the conflict might occur. 4. If this restriction creates a situation in which the Commission does not have enough eligible voting members to achieve a quorum, the Commission may involve the normally excluded member subject to the following conditions: a) The Chairperson will randomly and in a non-discretionary manner select the number of recused members to achieve a quorum; �Conflict of Interest Page2 5. b) Notwithstanding the above, no Commission member may, under any circumstances, participate in any discussions or decisions regarding a grant application submitted by an organization which he/she is or was affiliated according to the definition above; c) If recused members are included so as to achieve a quorum, the Commission must document the event and report it to the Corporation within 30 days of the vote. In addition, Commission members are restricted from directly assisting organizations of which they are a trustee, director, officer, or employee in preparing a grant application to the Commission. In general, the Michigan Community Service Commission wants to err on the side of too stringently enforcing conflict of interest policies in order to assure that both the fact and the perception of any unethical conduct is avoided.
